Subclass 866

Eligibility Criteria:

  • Must have arrived in Australia legally with a valid visa and been immigration cleared.
  • Must be a refugee.

Please note there are other requirements to meet as well. These are the baseline criteria.


Subclass 200, 201, 203, and 204

Eligibility Criteria:

  • Must be outside Australia at the time of application and at the time of decision.
  • You need to move to Australia due to facing persecution in your home country.

Details of Each Visa:

  1. Refugee (Subclass 200) Visa: For individuals referred by the United Nations High Commissioner to Australia for resettlement.
  2. In-Country Special Humanitarian (Subclass 201) Visa: For individuals unable to leave their home country and still living there.
  3. Emergency Rescue (Subclass 203) Visa: For individuals referred by the United Nations High Commissioner to Australia due to imminent danger.
  4. Woman at Risk (Subclass 204) Visa: For women at risk of danger without the protection of a relative or partner.

Subclass 202 Visa

Eligibility Criteria:

  • Must face substantial discrimination in your home country at the level of gross violation of human rights.
  • Must have a proposer who is an Australian citizen, Australian permanent resident, or Australian organisation.

Subclass 785

Eligibility Criteria:

  • Entered Australia illegally (without a visa) and were not immigration cleared on arrival.
  • Must be a refugee.

  • Entered Australia illegally (without a visa) and were not immigration cleared on arrival.
  • Must be a refugee.
