Employer Nomination Scheme (Subclass 186) Overview
The Employer Nomination Scheme (ENS) visa, subclass 186, allows skilled workers to live and work in Australia permanently. This visa has three streams:
- Temporary Residence Transition Stream (TRTS)
- Direct Entry Stream
- Labour Agreement Stream
The subclass 187 visa (Temporary Residence Transition Stream) was previously available for regional roles. However, this stream is now limited, and the subclass 494 visa has replaced the 187 Direct Entry program.
186 Visa Streams and Eligibility Criteria
1. Temporary Residence Transition Stream (TRTS)
This stream is designed for holders of subclass 457 or 482 visas who have worked in Australia for three years and wish to transition to permanent residency. Key requirements include:
- Employment: The applicant must have worked in the same occupation for the same employer for at least three years.
- Skills Assessment: Not required for this stream.
Process:
- Nomination by an employer.
- Visa application.
Nomination Requirements:
- The sponsoring business must be legal, operational, and actively running.
- A genuine need must exist for a full-time, ongoing position lasting at least two years.
- Nomination fee: $540.00.
Visa Requirements:
- The occupation must be listed on the Medium and Long-Term Strategic Skills List (MLTSSL).
- The applicant must be under 45 years old.
- The applicant can apply from inside or outside Australia.
- If applying within Australia, the applicant must hold a valid BVA, BVB, or BVC visa.
- Salary must meet the Annual Market Salary Rate (AMSR) and be no less than $53,900 (Temporary Skilled Migration Income Threshold, TSMIT).
- Fees:
- Primary applicant: $4,045.00
- Partner: $2,025.00
- Dependent child: $1,010.00
2. Direct Entry Stream
This stream is for skilled workers who:
- Have a positive skills assessment.
- Have at least three years of full-time work experience in their nominated occupation.
Process:
- Nomination by an employer.
- Visa application.
Nomination Requirements:
- The sponsoring business must be legal, operational, and actively running.
- A genuine need must exist for a full-time, ongoing position lasting at least two years.
- Nomination fee: $540.00.
Visa Requirements:
- The occupation must be listed on the MLTSSL.
- The applicant must be under 45 years old.
- The applicant can apply from inside or outside Australia.
- If applying within Australia, the applicant must hold a valid BVA, BVB, or BVC visa.
- Salary must meet the AMSR and be no less than $53,900 (TSMIT).
- Fees:
- Primary applicant: $4,045.00
- Partner: $2,025.00
- Dependent child: $1,010.00
3. Labour Agreement Stream
This stream is available under specific circumstances where the applicant is sponsored through a Labour Agreement. The Labour Agreement specifies age, English proficiency, and other criteria.
